These Terms of Service ("Terms") govern your use of beadnfloat.com (the "Site") and your purchase of products from BeadnFloat, operated by TODO, a company based in British Columbia, Canada ("BeadnFloat", "we", "us").
By using the Site or placing an order, you agree to these Terms. If you do not agree, do not use the Site. Nothing in these Terms excludes, restricts, or modifies any right or remedy you have under the Business Practices and Consumer Protection Act (British Columbia), the Sale of Goods Act (British Columbia), the Competition Act (Canada), or any other law that cannot be excluded by agreement. If any provision of these Terms conflicts with a non-waivable legal right, that right prevails.

2. Products
We sell fishing tackle, including soft beads, bead kits, and related terminal tackle. Product images are for illustration; minor variations in colour and finish may occur between production batches and due to screen settings. Bead sizes are stated in millimetres and are nominal manufacturing sizes.
Our products are fishing tackle, not toys. They are not intended for children and may present a choking hazard. See our Product Disclaimer for safety and regulatory information.
3. Orders and Contract Formation
Your order is an offer to purchase. A contract is formed when we send you an order confirmation email. That email, together with these Terms and the policies referenced in them, forms your distance sales contract, and we provide it to you at the time of purchase in a form you can retain.
We may decline or cancel an order where a product is unavailable, where there is an obvious pricing or description error, or where we reasonably suspect fraud. If we cancel an order you have paid for, we will refund you in full without deduction within 15 days.
4. Prices and Payment
All prices are in Canadian dollars (CAD) unless another currency is clearly displayed at checkout. The total price you will pay — including applicable GST/PST/HST and shipping — is displayed before you confirm your order. We do not add mandatory fees at checkout that were not disclosed in the advertised price, other than government-imposed taxes and the shipping option you select.
Payment is processed at checkout by our third-party payment processor(s) (TODO). We do not store your full card details.
5. Shipping and Delivery
Shipping methods, costs, and estimated delivery times are shown at checkout and in our Shipping Policy. Your order confirmation will state a delivery or supply date. If your order does not arrive within 30 days of that date (or within 30 days of purchase, if no date was given), you may cancel your contract and receive a full refund — see our Returns & Refunds Policy.
Risk in the goods passes to you on delivery. For international orders, you are the importer of record and are responsible for import duties and taxes levied by your country.
6. Returns, Refunds, and Cancellation
Our Returns & Refunds Policy forms part of these Terms. It includes both our voluntary 30-day returns program and a statement of your statutory cancellation rights under the BPCPA.
7. Warranties
Our goods come with implied conditions and warranties under the Sale of Goods Act (British Columbia) and equivalent consumer laws, including that they are of merchantable quality, fit for purpose, and durable for a reasonable period. These cannot be excluded in a consumer sale and we do not exclude them. To the extent permitted by law, and except for those non-excludable rights, the Site and its content are provided "as is" and we make no additional warranties beyond those stated in product descriptions.
8. Responsible Use of Fishing Products
Fishing regulations — including rules on bead rigs, pegged beads, hook types, and bait restrictions — vary by province, state, and water body and change over season. You are solely responsible for ensuring your rig and methods comply with the regulations where you fish. Product descriptions and guides on this Site are general information, not confirmation of legality in your jurisdiction.
9. Site Use and Intellectual Property
All content on the Site — text, product photography, graphics, guides, and the BeadnFloat name and logo — is owned by or licensed to us and protected by copyright and trademark law. You may not scrape, republish, or commercially exploit Site content without our written permission. You may share links to the Site and quote short excerpts with attribution.
You agree not to misuse the Site, including by attempting to gain unauthorised access, interfering with its operation, or using it for unlawful purposes.
10. Reviews and User Content
You are free to post honest reviews of our products anywhere, positive or negative. Nothing in these Terms restricts or penalises you for publishing or communicating a review of our goods, services, or your transaction with us. If you submit content to us (reviews, photos, catch reports), you grant us a non-exclusive, royalty-free licence to display it on the Site and in our marketing, with credit where practical. You must not submit content that is unlawful, infringing, or that you do not have the right to share.
11. Liability
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be limited by law — including our obligations under the BPCPA and the implied conditions under the Sale of Goods Act.
Subject to the paragraph above, we are not liable for losses that are not a reasonably foreseeable result of our breach, for loss of catch or opportunity, or for your failure to comply with fishing regulations. Subject to the same paragraph, our total liability in connection with an order is limited to the amount you paid for that order.
12. Privacy
Our Privacy Policy explains how we handle your personal information under the Personal Information Protection Act (British Columbia) and PIPEDA.
13. Changes to These Terms
We may update these Terms from time to time. The version in force when you place an order applies to that order. We do not unilaterally amend the terms of an existing order.
14. Governing Law and Disputes
These Terms and any purchase are governed by the laws of British Columbia and the federal laws of Canada applicable in it. These Terms do not require arbitration, do not waive your right to participate in a class proceeding, and do not restrict your choice of forum. You may bring a claim in the courts of British Columbia, through BC's Civil Resolution Tribunal where it has jurisdiction, or in any other forum available to you by law. If you reside outside British Columbia, these Terms do not deprive you of the protection of mandatory consumer laws of your place of residence.
15. General
If any provision of these Terms is found invalid or unenforceable, the remainder continues in force. These Terms, together with your order confirmation and the policies referenced above, are the entire agreement for your purchase. Our failure to enforce a provision is not a waiver of it.
